Confinement Conditions Persist

Despite a change in command at the Quantico Brig, PFC Manning remains in maximum custody and under prevention of injury watch.  On January 19, 2011, the defense filed an Article 138 complaint with the Quantico base commander, Colonel Daniel Choike.  The complaint alleges the brig commander, CWO4 James Averhart, abused his discretion by maintaining PFC Manning under the current confinement conditions.  The government has yet to respond to the Article 138 complaint or give a justification for the ongoing nature of PFC Manning's conditions of confinement.  Under Navy regulations, the command has 90 days to issue its response to the complaint.  Once the government responds, the defense is given 7 days to file a rebuttal, if necessary, before the matter is ultimately forwarded to the Secretary of the Navy for final action.

  1. That is so wrong Im not sure where to begin. Even if he did make a mistake and send Wikileaks those cables. Why is he in solitery he is 19. Hardily a threat to anyone other than himself. This isn't going to stop people releasing of classfied information it is going to do the opposite, its an outrage. He is so young its your fault for putting him in this position. Why is his commander not in jail.

  2. I suppose the command will take the full 90 days to answer the
complaint. In the meantine, PFC Manning isn't being punished because
'punishment doesn't happen till after he would be found guility.' I
feel so bad that my country has fallen to such low tactics. No rule of
law, compassion from the "captors." They are punishing him eventhough
he has not been convicted of any crime. And this irresponsible
behavior goes on and on throughout our government, at every level,
from Obama down to the lowest officer/office worker.

  3. Of course. Why am I not surprised? He will be brought before a kangaroo court in secret only after the date he is supposed to be released, and he will absolutely not be able to participate in his own defense. This is beyond disgusting.

Hamdi, Padilla and now Manning. What good does it do the United States to put someone one trial once he's been reduced to a vegetable?

He is a modern-day real-life Jesus Christ, who is giving his life but first his mind and soul to save humanity, IF and ONLY IF the US Government collapses and disappears like the old Soviet Union. Otherwise, it's World War 3. And no, Revolution is not feasible.
